US-China AI chip export control mechanism: BIS case-by-case review plus China's own domestic-chip mandate
On January 13, 2026, BIS announced a final rule shifting export license review for NVIDIA H200 (and AMD MI325X) chips bound for China from a presumption of denial to case-by-case review, following President Trump's December 8, 2025 announcement allowing shipment to approved customers -- subject to a 25% tariff, a 50% volume cap, third-party testing, and KYC requirements. Separately, on the China side: China's internet regulator barred major domestic tech firms from purchasing NVIDIA chips in September 2025, and in November 2025 Beijing mandated that state-funded data center projects use only domestic AI chips, a directive that covers even BIS-licensed H20/H200 units. The practical result is a US policy that permits limited sales colliding with Chinese policy that discourages domestic purchase -- both sides of the constraint should be understood together, not just the US export-control side.
